Terms & Conditions
(1) Scope
These General Terms and Conditions govern the contractual relationship between Sicula Bike, hereinafter referred to as the "Rental Company", and the renter of bicycles, hereinafter referred to as the "Renter".
(2) Subject of the contract, Rent
(a) The Rental Company rents out bicycles exclusively to guests of selected Solemar Sicilia holiday apartments.
(b) The Rental Company shall provide the Renter with the bicycles and accessories specified in the rental agreement for the contractually agreed rental period in return for the agreed rent.
(c) The Renter shall pay the agreed rent in advance. If the rental period is extended, the remuneration owed shall be due for payment immediately. If the bikes are returned prematurely, the contractually agreed rental fee will not be refunded.
(d) The Rental Company may demand a security deposit when the bicycles are handed over, which will be refunded upon proper return of the bicycles. It is the responsibility of the Renter to find out the amount of any deposit required in good time beforehand.
(e) By concluding the rental agreement, the Renter confirms that he is experienced in handling derailleur gears and in riding with assistance from electric motors.
(f) By concluding the rental agreement, the Renter also confirms that he understands that there are no cycle paths in the catchment area of the Solemar Sicilia holiday flats and that he feels able to take part in everyday rural and urban traffic with the rented bicycle.
(3) Rental period, Cancellation
(a) The contractual rental period is based on the provisions of the rental agreement.
(b) The minimum rental period is one week.
(c) Unless otherwise agreed, free cancellation is possible up to 2 weeks before the start of the rental period. Thereafter, a cancellation fee of 30% must be paid.
(4) Delivery, Return
(a) The day before the start of the rental period, the Rental Company brings the rented bicycles to the Renter's holiday apartment, places the supplied accessories in the holiday apartment, documents the status photographically and sends the photos to the Renter by email.
(b) On the day the rent ends, the Renter returns the bicycles and accessories as he found them at the start of the rent, documents the status photographically and sends the photos to the Rental Company by email.
(c) The Rental Company will collect the bicycles and accessories at the end of the rental period.
(d) The costs for bringing and collecting the bicycles shall be borne by the Rental Company.
(5) Contractual obligations
(a) The Renter shall receive the bicycles from the Rental Company in a safe operating condition.
(b) The bicycles are provided to the Renter for personal use only. This includes fellow travellers.
(c) The Rental Company makes the operating instructions for the rented bicycles available on its website. By concluding the rental agreement, the Renter recognises receipt of the operating instructions.
(d) The Renter may only have the handlebar height, brakes and gears adjusted by specialised personnel. The Rener may adjust the seat height himself.
(e) The Renter may only use the bicycle in a manner that is customary in traffic and in accordance with its design and in compliance with all public law regulations, in particular the road traffic regulations. In particular, the bicycle must be used and treated properly, carefully and gently. The operating instructions and other manufacturer's instructions in the user manual must be observed.
(f) The Renter is obliged to ensure that other road users are not hindered when parking the bicycle.
(g) During the rental period, the Renter is obliged to maintain the bicycle in a condition in accordance with the contract. He must avoid overuse in every way and protect the bicycle against unfavourable weather conditions and damage to property.
(h) The Renter is obliged to take all suitable and objectively necessary measures owed under this contract to prevent improper handling by third parties and in particular to prevent theft of the bicycle. The Renter is therefore obliged to lock the bicycle when parking it. The Rental Company shall provide a chain lock for this purpose. The bicycle must be locked to a stationary object. As a minimum, the fixed object, the frame and the rear wheel must be firmly locked and connected to each other. In the event of theft or partial loss of the bicycle, the Renter must inform the Rental Company immediately.
(i) The risk of loss lies with the Renter. Lost, stolen or destroyed accessories will be offset against the deposit at the current list price. If bicycles are lost, stolen or destroyed, the entire deposit will be retained.
(j) The Renter must report any faults, defects and damage to the bicycle to the Rental Company immediately after becoming aware of them, particularly if the bicycle is no longer safe to use or roadworthy. Damage that has since been repaired must also be reported to the Rental Company at the latest when the bicycle is returned. In the event of a breach of this obligation to notify, the Renter shall be obliged to compensate the Rental Company for any damage caused by the breach of this obligation to notify.
(6) Utilisation by third parties
(a) The Renter may only leave the bicycles to persons travelling with him. Subletting or other transfer of use to other third parties is not permitted.
(b) The Renter shall oblige any persons travelling with him to use the bicycle exclusively for themselves and not to leave it to third parties.
(c) If the hirer provides bicycles to persons travelling with him, he must inform them of these General Terms and Conditions.
(7) Liability
(a) The use of bicycles is at your own risk.
(b) All damage due to defects or lost keys must be compensated in full by the Renter, regardless of fault.
(c) The Renter shall be liable without limitation for all damage incurred by the Rental Company as a result of the Renter's breach of contractual obligations and for all damage caused by wilful or grossly negligent acts or omissions. The Renter shall also be liable for such damage if it is caused by third parties who use the rented bicycles with the Renter's consent.
(d) Unless otherwise stated in the rental agreement, there is no insurance for the bicycles.
(e) In the event of damage that is attributable to normal wear and tear and leads to loss of use, the Rental Company shall be responsible for rectifying the damage at his expense.
(f) The Rental Company is only liable for damage caused by gross negligence or intent. Liability for accidents suffered by the Renter is excluded.
(g) The Rental Company accepts no liability for errors and misprints.
(8) Privacy
The Rental Company undertakes to use the Renter's personal data exclusively for the purpose of processing the rental agreement and not to pass it on to third parties.
